TERMS OF SERVICE, TRADING RISK & IMPORTANT DISCLOSURE

These Terms of Service, Trading Risk & Important Disclosure ("Terms") govern your access to and use of the Trading Transformations website, educational programs, courses, training materials, software, tools, Quant Pilot, communications, and related services (collectively, the "Services") provided by Global Transformations LLC, doing business as Trading Transformations and/or Quant Pilot ("Company," "we," "us," or "our").

By accessing, purchasing, enrolling in, or using any of our Services, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not access or use the Services.

1. EDUCATIONAL AND INFORMATIONAL PURPOSE ONLY

Trading Transformations provides educational content, training, courses, resources, and tools relating to trading and financial markets.

Quant Pilot is a technology platform that uses automated data analysis to generate market-related information, alerts, and other analytical outputs.

The Services are provided solely for educational and informational purposes.

Nothing contained in the Services constitutes:

  • Personalized investment advice

  • Financial advice

  • Legal advice

  • Tax advice

  • Portfolio management

  • Account management

  • A recommendation to buy, sell, or hold any security, futures contract, cryptocurrency, or other financial instrument

  • An offer or solicitation to buy or sell any financial instrument

We are not your investment adviser, broker-dealer, commodity trading advisor, or other financial professional solely by providing the Services described in these Terms.

You are solely responsible for making your own trading and investment decisions.

2. TRADING INVOLVES SUBSTANTIAL RISK

Trading financial markets involves substantial risk and is not suitable for everyone.

You may lose some or all of the capital you commit to trading.

You should never trade with money you cannot afford to lose.

Past performance is not indicative of future results.

No representation or guarantee is made that you will achieve profits, recover losses, generate income, or achieve any particular financial result through the use of Trading Transformations, Quant Pilot, or any related Service.

Market conditions can change rapidly and unexpectedly, and trading results can vary significantly from one person to another.

You are responsible for determining whether trading is appropriate for your individual circumstances and for determining the amount of capital and risk you are willing to assume.

3. QUANT PILOT IS NOT A TRADE EXECUTION SERVICE

Quant Pilot does not execute trades on your behalf.

Quant Pilot does not manage your brokerage account, control your trading account, or place orders for you.

You remain in control of your trading account and are solely responsible for deciding whether, when, and how to enter, modify, or exit any trade.

You are responsible for independently evaluating any information, alert, output, or other information provided through Quant Pilot before taking any action.

4. QUANT PILOT ANALYTICAL OUTPUTS AND ALERTS

Quant Pilot may analyze market data and other information using automated technology and may generate alerts, notifications, analytical outputs, probabilities, or other information.

These outputs are provided for informational and educational purposes only.

They are not guaranteed trade opportunities, instructions, or directives to buy, sell, or hold any financial instrument.

An alert or output should not be interpreted as a representation that a particular trade will be profitable or appropriate for you.

The existence of an alert or other output does not eliminate the need for independent judgment, risk management, or evaluation of current market conditions.

You acknowledge that any decision to act on information provided by Quant Pilot is made independently by you.

5. NO RELIANCE ON QUANT PILOT

By using Quant Pilot, you acknowledge that you are not relying on Quant Pilot as a substitute for your own judgment or for professional financial advice.

You remain solely responsible for evaluating:

  • Market conditions

  • Risk and potential reward

  • Position size

  • Entry and exit decisions

  • Stop-loss and risk-management decisions

  • Your available capital

  • Your trading objectives

  • Whether any trade is appropriate for you

Any use of Quant Pilot's information, alerts, tools, or outputs is undertaken at your own risk.

6. REAL-TIME DATA, ALERTS AND EXECUTION LIMITATIONS

Financial markets and technology systems operate in rapidly changing environments.

Alerts, notifications, data, and system outputs may be delayed, interrupted, incomplete, inaccurate, or no longer relevant by the time they are received or viewed.

We do not guarantee:

  • Real-time delivery of alerts

  • Uninterrupted delivery of notifications

  • Accuracy or completeness of market data

  • Accuracy of displayed prices

  • Accuracy of entry or exit levels

  • Availability of any particular market or data source

  • That an alert will be received before market conditions change

  • That a trade can be executed at a displayed or indicated price

  • That any brokerage or trading platform will accept or execute an order

  • That any particular trading opportunity will remain available

You are solely responsible for determining whether and how to act on any information provided through the Services.

7. TECHNOLOGY AND PLATFORM RISKS

The Services depend on technology, internet connectivity, third-party platforms, data providers, brokerage systems, and other infrastructure that may be outside our control.

Technology-related risks may include:

  • Internet connectivity failures

  • Hardware or software failures

  • Platform outages

  • Data-feed interruptions

  • Delayed or missing notifications

  • Market-data inaccuracies

  • Third-party service interruptions

  • Brokerage or trading-platform outages

  • Communication failures

  • Cybersecurity incidents

  • System maintenance

  • Software errors or bugs

We do not guarantee that the Services will be uninterrupted, error-free, secure, or continuously available.

We are not responsible for losses resulting from delays, outages, interruptions, inaccurate data, technical failures, or other technology-related circumstances beyond our reasonable control.

8. TRADING TRANSFORMATIONS EDUCATIONAL SERVICES

Trading Transformations may provide courses, educational materials, videos, training, tools, templates, resources, support, community access, and other educational content.

The specific Services included with your purchase or enrollment are those described at the time of purchase, subject to reasonable updates, modifications, improvements, or substitutions.

Educational materials are intended to help you develop your own knowledge, understanding, processes, and decision-making skills.

Completion of any course or educational program does not guarantee trading success or profitability.

9. NO GUARANTEE OF RESULTS

We do not guarantee that you will:

  • Make money

  • Become a profitable trader

  • Achieve a particular return

  • Recover trading losses

  • Generate supplemental or replacement income

  • Achieve financial independence

  • Achieve results similar to those described by another person

  • Achieve any specific trading or financial outcome

Your results depend on many factors, including your experience, knowledge, discipline, risk management, available capital, trading decisions, market conditions, technology, and numerous other factors outside our control.

10. PERFORMANCE CLAIMS, EXAMPLES AND TESTIMONIALS

Any examples, case studies, performance information, testimonials, reviews, screenshots, trading results, or statements regarding individual experiences are provided for illustrative purposes and reflect the experience or opinion of the person presenting them.

Individual experiences are not guarantees of future performance.

No testimonial or example should be understood to mean that you will achieve the same or similar results.

Where specific results are presented in our marketing, those results may reflect circumstances that are not representative of the experience of other users.

Any objective claims regarding the Services are intended to be supported by information and evidence appropriate to the claim.

11. YOUR RESPONSIBILITY

You are responsible for:

  • Your brokerage relationship

  • Your position sizing

  • Your gains and losses

  • Your compliance with applicable laws and regulations

  • Determining whether the Services are appropriate for you

We do not execute trades for you unless a separate written agreement expressly provides otherwise.

12. NO BROKERAGE, ACCOUNT MANAGEMENT OR PERSONALIZED ADVICE

We are not your broker or brokerage firm.

We do not take custody of your trading capital.

We do not manage your brokerage account.

We do not have authority to make trading decisions on your behalf.

We do not provide personalized investment advice based on your individual financial circumstances.

You should consult a qualified financial, tax, legal, or other professional regarding your individual circumstances where appropriate.

13. INTELLECTUAL PROPERTY

All content and materials made available through the Services, including but not limited to:

  • Courses

  • Videos

  • Written materials

  • Graphics

  • Software

  • Technology

  • Tools

  • Templates

  • Systems

  • Processes

  • Trademarks

  • Logos

  • Trade names

  • Educational materials

  • Quant Pilot technology and related materials

are owned by or licensed to the Company and are protected by applicable intellectual property laws.

Your purchase or enrollment provides you with a limited, personal, non-exclusive, non-transferable right to access and use the Services for your own lawful educational purposes.

You may not:

  • Copy or reproduce proprietary materials

  • Share your login credentials

  • Share paid access with another person

  • Resell or redistribute our materials

  • Record and redistribute training

  • Publish proprietary content without permission

  • Reverse engineer proprietary software

  • Attempt to obtain unauthorized access to our systems

  • Use our proprietary materials to create a competing product or service

  • Remove copyright, trademark, or proprietary notices

14. ACCOUNT SECURITY

If you receive account credentials, you are responsible for maintaining their confidentiality and security.

You may not permit another person to use your account or access paid Services through your credentials.

We reserve the right to suspend or terminate access where an account is shared, transferred, abused, compromised, or used in violation of these Terms.

15. PAYMENTS AND PURCHASES

You agree to pay all charges associated with the Services you purchase.

Pricing, payment schedules, subscription terms, renewal terms, and other material purchase terms will be disclosed before you complete your purchase.

If a payment is declined or otherwise fails, we may suspend access to applicable Services until payment is successfully processed.

16. CANCELLATION AND REFUND POLICY

Any cancellation and refund terms applicable to your purchase will be disclosed at the time of purchase and are incorporated into these Terms.

Unless otherwise expressly stated in writing, payments are non-refundable after the applicable refund period has expired.

17. SMS AND TEXT MESSAGE COMMUNICATIONS

If you affirmatively consent to receive marketing text messages from us, you authorize us to send SMS messages to the mobile telephone number you provide.

Messages may include educational content, promotional information, consultation or appointment reminders, product information, offers, and other communications related to Trading Transformations, Quant Pilot, and related Services.

Message frequency varies. Message and data rates may apply.

Consent to receive marketing text messages is not a condition of purchasing any product or service.

You may opt out of marketing text messages at any time by replying STOP to a marketing message.

You may reply HELP for assistance.

After opting out, you may receive a confirmation message. No further marketing messages will be sent unless you subsequently provide consent.

We may maintain records of SMS consent, including the telephone number, date and time of consent, source of consent, and other information reasonably necessary to demonstrate compliance.

18. EMAIL AND ELECTRONIC COMMUNICATIONS

We may communicate with you electronically regarding your account, purchases, Services, educational content, and promotional offers, as permitted by applicable law.

Marketing emails will include an appropriate method for unsubscribing from future marketing communications.

You may unsubscribe from marketing emails at any time by using the unsubscribe mechanism included in the email.

Opting out of marketing communications does not prevent us from sending transactional or service-related communications necessary to administer your account, process a transaction, or provide Services you have purchased.

Commercial email communications will be handled in accordance with applicable law, including applicable requirements concerning sender identification, physical mailing address, and opt-out mechanisms.

Our Services may use or integrate with third-party platforms and services, including payment processors, brokerage and trading platforms, data providers, website hosting providers, email and SMS providers, scheduling platforms, analytics services, and other technology providers.

Third-party services may have their own terms of service and privacy policies.

We are not responsible for the availability, security, performance, policies, or practices of third-party services.

20. PROHIBITED USE

You agree not to use the Services:

  • For any unlawful purpose

  • To violate applicable laws or regulations

  • To interfere with the operation of the Services

  • To obtain unauthorized access to our systems

  • To circumvent security measures

  • To share unauthorized access

  • To copy or redistribute proprietary materials

  • To reverse engineer proprietary technology

  • To create a competing product using our proprietary materials

  • In any manner that could damage, disable, overburden, or impair our Services

21. SUSPENSION OR TERMINATION

We may suspend or terminate your access to the Services if you:

  • Violate these Terms

  • Fail to make required payments

  • Share unauthorized access

  • Misuse the Services

  • Attempt to compromise our systems

  • Engage in abusive or unlawful conduct

Termination does not eliminate obligations that by their nature should survive termination, including payment obligations, intellectual property protections, disclaimers, limitations of liability, and indemnification obligations.

22. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis.

We do not warrant that:

  • The Services will be uninterrupted

  • The Services will be error-free

  • Information will always be accurate or complete

  • Alerts will always be timely

  • Data will always be available

  • Technology will always function without interruption

  • Any particular trading result will occur

We disclaim warranties, express or implied, to the maximum extent permitted by applicable law, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement, except where such warranties cannot legally be excluded.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Global Transformations LLC, Trading Transformations, Quant Pilot, and their respective owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Services.

This includes, without limitation:

  • Trading losses

  • Lost profits

  • Lost opportunities

  • Loss of income

  • Loss of data

  • Business interruption

  • Technology failures

  • Market losses

  • Losses resulting from delayed or inaccurate information

  • Losses resulting from reliance on or use of any alert, output, tool, or educational content

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

24. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Global Transformations LLC, Trading Transformations, Quant Pilot, and their respective owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising out of or related to:

  • Your violation of these Terms

  • Your misuse of the Services

  • Your violation of applicable law

  • Your trading activity

  • Your use of third-party services

  • Your unauthorized use or distribution of our materials

25. PRIVACY

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Our Privacy Policy explains how we collect, use, disclose, and protect personal information, including information collected through our website, forms, email communications, SMS communications, purchases, and use of our Services.

26. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Services will be handled in a court of competent jurisdiction in Miami-Dade County, Florida, unless otherwise required by applicable law.

27. CHANGES TO THESE TERMS

We may modify these Terms from time to time.

Updated Terms will be posted on our website with a revised Effective Date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

28. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

29. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, applicable purchase terms, refund policy, and any other written agreements expressly incorporated by reference, constitute the agreement between you and Global Transformations LLC regarding your use of the Services.
